Encounters between people and livestock are uncommon in recreational areas, but when they occur, the results can be severe. Large animals such as cattle can weigh well over 1,000 pounds, and an unexpected charge can cause catastrophic injuries. A recent incident in Delta, Colorado, left a volunteer mountain bike trail builder hospitalized with life-threatening injuries after he was attacked by a cow during a trail work day.

What Happened at Confluence Park in Delta?

According to Singletracks, the incident occurred on Thursday, February 26, 2026, while volunteers were performing trail work at Confluence Park in Delta, Colorado.

Dan Wegelin, a board member of the Delta Area Mountain Bikers (DAMB) and a local trail builder, was working on the trails when a cow escaped from a nearby sale yard and entered the area.

Witness accounts indicate that Wegelin noticed the animal at about the same time he saw a friend nearby with young children. He reportedly called out to warn them to move away, at which point the cow turned its attention toward him.

According to Wegelin, the cow appeared agitated and charged toward him, knocking him down a 10-foot embankment. The animal then reportedly fell down the hill as well, landing on top of him. The cow remained on top of him for a short time while attempting to stand before eventually rolling off, allowing Wegelin to crawl away and reach his truck.

Emergency responders transported him to a local hospital, and he was later transferred to the intensive care unit at St. Mary’s Hospital in Grand Junction due to the severity of his injuries.

Reports indicate Wegelin suffered a collapsed lung, pneumothorax, four vertebral fractures, crushed ribs, shoulder injuries, broken fingers, knee injuries, a broken clavicle, and numerous cuts and abrasions.

Could the Livestock Owner Be Held Liable?

Colorado generally follows open-range principles, meaning livestock owners are not automatically responsible simply because an animal leaves its enclosure. However, owners may still face liability if an animal escapes due to negligence or a failure to properly contain it.

In this case, investigators would likely examine how the cow escaped from the nearby sale yard and whether reasonable steps were taken to prevent livestock from leaving the facility and entering nearby public areas like Confluence Park.

Key questions may include:

  • Whether fencing or enclosures at the sale yard were properly maintained;
  • Whether gates or barriers were left open or unsecured;
  • Whether the facility had a history of livestock escaping; and
  • Whether adequate precautions were in place to protect nearby public spaces.

If the animal escaped because of improper containment or poor maintenance, the owner or operator responsible for the livestock could potentially face civil liability for Wegelin’s injuries. The outcome will depend on the facts uncovered during the investigation.

The Dangers of Large Animal Encounters

Cattle are powerful animals that can weigh over half a ton, making even brief encounters extremely dangerous. When startled or agitated, cows may charge, kick, or trample people in their path.

Unlike typical recreational injuries on trails, incidents involving livestock can involve crushing injuries, broken bones, and internal trauma due to the size and weight of the animal.

In this case, the combination of a steep embankment and the animal’s weight significantly increased the severity of the injuries suffered.

Why Livestock Injury Cases Can Be Complex

Incidents involving livestock outside of agricultural settings often raise complicated legal questions. Investigators may need to determine where the animal originated, how it escaped, and whether reasonable containment measures were in place.

Responsibility may also depend on property boundaries, fencing requirements, and the actions of the livestock owner or facility. These cases can involve multiple parties, including property owners, livestock facilities, and insurance carriers.

Because each situation depends heavily on the facts surrounding the animal’s escape, a thorough investigation is often required to determine liability.
