Case Result: $225,000 Settlement for Andrew N. After Crash Involving Escaped Cow

What Happened

While driving to work before sunrise on Fahey Road in Gustine, Andrew Nieto swerved to avoid a vehicle with its headlights pointed at him—only to hit a cow lying in the road. The impact caused his SUV to flip and crash through a fence. The cow had escaped from a nearby dairy and had just been hit by another driver moments earlier.

Legal Challenge

Although the dairy farm admitted partial responsibility, they tried to assign blame to Andrew. Silva Injury Law pushed back, showing that the property owner failed to maintain secure fencing and that Andrew had no reasonable way to avoid the accident.

Injuries & Outcome

Andrew suffered a severe thigh hematoma requiring surgery, neck and back trauma, cognitive issues, and PTSD. He was unable to work for extended periods and struggled with parenting duties due to physical limitations. Silva Injury Law fought for full accountability and won a $225,000 settlement to cover his injuries, medical expenses, and lost wages.

Case Result: $200,000 Settlement for Brandi P. After Highway Cow Collision

What Happened

Brandi Pisano was driving on a dark, rainy morning along Highway 145 in Madera, California, when she suddenly struck three black cows that had wandered into her lane. The impact caused her car to spin out and fill with smoke. Brandi managed to escape the vehicle, but not without significant injuries.

Legal Challenge

The cows were owned by a nearby rancher who claimed a tree had broken part of his fence. However, Silva Injury Law’s investigation revealed widespread disrepair throughout the fencing. The defense argued Brandi was driving too fast, but we proved she was actually going under the speed limit and was familiar with the road.

Injuries & Outcome

Brandi sustained chronic back and neck injuries, a concussion, lumbar stenosis, and developed chronic pain syndrome. She required ongoing spinal injections and was facing potential surgery. With strong evidence of the rancher’s negligence and clear documentation of Brandi’s suffering, Silva Injury Law secured a $200,000 settlement on her behalf.
