Rear-end collisions involving animal-drawn carts can have devastating consequences, especially when children are involved. A February 20, 2026, crash in Elkhart County claimed the lives of two young children and left two others seriously injured after a pickup truck struck a westbound pony-drawn cart from behind.

What Happened on State Road 4?

According to WNDU, the crash occurred last Friday morning on State Road 4, just west of County Road 37. Police reported that a 40-year-old man was driving a pickup truck westbound on State Road 4 when he hit the back of a pony-drawn cart traveling in the same direction.

The cart was carrying four children at the time of the crash. Seven-year-old Derek Bontrager and eight-year-old Jenna Miller were pronounced dead at the scene. The pony pulling the cart also died as a result of the collision.

Two other children, ages 11 and 13, were transported to the hospital with serious injuries. Authorities have not provided an update on their conditions.

Police confirmed that the pickup truck driver remained at the scene and cooperated with investigators. Toxicology results are pending, and the crash remains under investigation. No arrests have been made at this time.

Can the Pickup Driver Be Held Liable?

Under Indiana law, motorists have a duty to operate their vehicles with reasonable care and maintain a proper lookout. Drivers must also adjust their speed and following distance based on roadway conditions and surrounding traffic, including slower-moving vehicles such as horse- or pony-drawn carts.

In rear-end crashes, investigators often examine whether the driver was following too closely, distracted, speeding, or otherwise inattentive. Even in the absence of alcohol or drugs, a failure to maintain proper control or awareness can constitute negligence. If evidence shows the pickup driver breached that duty of care, civil liability may follow for wrongful death and personal injury claims on behalf of the children and their families.

The Vulnerability of Animal-Drawn Carts

Animal-drawn carts offer virtually no crash protection. Unlike modern vehicles, they lack seat belts, airbags, reinforced frames, or crumple zones. When struck from behind, occupants can be thrown forward or crushed, and the animal pulling the cart is often killed or severely injured.

On rural highways where speeds are higher and reaction times shorter, the risk of catastrophic injury increases significantly, especially when drivers fail to anticipate slower-moving traffic ahead.

Why These Cases Are Complex

Crashes involving animal-drawn vehicles raise complicated legal and factual issues. Investigators must determine visibility, speed, roadway design, and whether the driver exercised reasonable care under the circumstances. Pending toxicology reports may also influence the outcome.

Additionally, these cases often involve significant insurance questions, including wrongful death claims, personal injury damages for surviving victims, and property loss related to the animal.
