Crashes involving horse-drawn buggies and modern vehicles often result in catastrophic consequences due to the significant differences in size, speed, and protection afforded by these vehicles. A September 4, 2025, collision in Herkimer County, New York, illustrates the dangers faced by Amish families traveling rural roads where motor vehicles and buggies share limited space.

What Happened

According to The New York Post, eight Amish passengers were ejected from their horse-drawn buggy when a pickup truck struck them from behind on Route 5 in the Town of Danube.

New York State Police reported that 73-year-old Laurie Callan was driving a 2012 Dodge pickup when it collided with the two-horse buggy shortly after 5:30 p.m. Monday. The impact killed one of the horses and sent the wagon careening off the road, ejecting all eight occupants. A six-year-old boy was taken to Wynn Hospital in Utica with non-life-threatening injuries, while Callan was treated at a local hospital for minor injuries. No other serious injuries were reported.

Troopers said the collision caused the truck to flip and land in the westbound lane. The investigation into the cause of the crash remains ongoing.

Can the Driver Be Held Liable?

Under New York’s Vehicle and Traffic Law, motorists must maintain a safe following distance to avoid rear-end collisions. Drivers are also required to exercise extra caution when approaching slow-moving vehicles, including horse-drawn buggies, which are common in rural counties such as Herkimer.

If investigators determine that speed, inattention, or failure to maintain distance caused the crash, the driver could be found negligent. Even when alcohol or impairment are not factors, civil liability can still arise if carelessness or unsafe driving leads to injury or loss of life.

The Vulnerability of Horse-and-Buggy Passengers

Unlike cars or trucks, buggies provide virtually no protection in a crash. They lack seatbelts, airbags, and reinforced structures, leaving riders vulnerable to direct impact. A rear-end collision often throws occupants from the carriage and can injure or kill the horses pulling it. For families who rely on buggies for daily transportation, these accidents pose a constant risk.

Why These Cases Are Complex

Collisions involving horse-drawn vehicles require detailed analysis to determine fault. Investigators will review roadway conditions, visibility, the presence of reflective materials or lamps on the buggy, and the driver’s speed and attentiveness. Insurance coverage can also complicate recovery, as these cases may involve both motor vehicle and livestock liability.
