Gravette, AR (June 5, 2025) — A collision involving a loose horse on Interstate 49 claimed the life of 77-year-old Fayetteville resident Dona Smith and injured her passenger in the early morning hours of June 5, according to the Arkansas State Police.

Incident Details: The fatal crash occurred around 2:15 a.m. near the 99-mile marker of southbound I-49. Smith was driving when her vehicle struck a horse standing in the roadway. After the impact, her car veered off the highway and crashed into a road sign. Smith was pronounced dead at the scene. Her passenger, a 78-year-old man, sustained injuries and was transported for medical care. The crash report noted foggy conditions but dry pavement at the time of the accident.

Investigation and Legal Considerations: Authorities continue investigating the collision and will determine how and why a horse was on an interstate highway at that hour. Livestock owners are generally required to secure their animals to prevent them from wandering onto public roads. 

Pending the investigation’s findings, the Smith family may have grounds to pursue a wrongful death claim to compensate for funeral costs, loss of companionship, and other compensable damages. The injured passenger may file a personal injury claim to help him with his medical and rehabilitation expenses, as well as pain and suffering or emotional distress.
